EU machinery law: the working framework
Understand which machinery framework applies, what changes in 2027 and how to organise the evidence behind conformity.
The Directive remains the current framework before 20 January 2027. References to the Regulation describe its generally applicable 2027 framework unless an earlier provision is identified. This is independent educational information.
Start with the applicable date
For machinery placed on the EU market before 20 January 2027, the current Machinery Directive 2006/42/EC remains the applicable machinery framework. Regulation (EU) 2023/1230 generally applies from that date. Entry into force and general application are different events: selected administrative and institutional provisions already apply earlier.
A procurement date or the date a drawing was approved is not, by itself, proof of when an individual product was first placed on the market. Keep the product identity and the evidence supporting the relevant supply event together. Products lawfully placed on the market under the Directive before the cut-off may continue to be made available under Article 52.
Define the product before choosing a route
The legal framework covers several product categories, not only complete production machines. Establish whether the item is machinery, a related product or partly completed machinery, and review the exclusions. A component supplied for incorporation may follow a different documentation pathway from a complete machine.
Other EU product legislation can apply alongside machinery legislation. Where more specific legislation addresses the same risks, the machinery framework contains rules for that overlap. Record the reasoning rather than assuming that one familiar directive covers every aspect of the product.
Build the argument for conformity
The manufacturer needs an engineering basis for the applicable requirements: risk assessment, design measures, verification and technical documentation. The assessment procedure depends on the framework and category. CE marking and the relevant declaration follow the required conformity work; a logo, supplier claim or voluntary certificate is not a substitute for it.
Under the Regulation, essential health and safety requirements are in Annex III, technical documentation in Annex IV and declarations in Annex V. Those annex numbers differ from the Directive. Avoid reusing an old document reference without checking the law behind it.
Use this reference in a project
Begin with product scope, the market event and the responsible economic operator. Then link each relevant requirement to a design decision and to evidence. Assign document ownership so the supporting record can be retrieved when requested.
This publication explains the framework. It cannot determine the conformity of a particular machine. Product-specific interpretation, testing and assessment require competent people and the applicable official text.
